NOTICE OF JUDICIAL SALE BY TENDER

NORTHWEST TERRITORIES SUPREME COURT FILE S-1-CV-2018-000 432 (NORTHWEST TERRITORIES BUSINESS DEVELOPMENT AND INVESTMENT CORPORATION v. CONCEPT ENERGY SERVICES LTD. et al.)

The Property: 29-33 102 Avenue and 27 & 28 102 Avenue Hay River, NT. Legally described as Portions (REM): Lots 79, 80, 81 and all of 96 and 97, Plan 38 Hay River, Northwest Territories. The Property is for sale by judicial tender pursuant to a Court Order granted January 7, 2022. The sale is based upon the Property “as is where is” with no conditions and it is for sale based upon the asking price of $770,000.00. The Property consists of three contiguous T – Transportation zoned parcels providing a total site area of approximately 4.32 acres, or ±188,526 square feet. Plus, two Lots across the street, and west (Lots 96 and 97) that have a combined area of 81,021 square feet. Offers with tender bids in sealed envelopes marked S-1-CV-2018-000 432 and accompanied by a certified cheque or money order for 10% of the amount of the tender payable to Supreme Court of the Northwest Territories must be in the hands of the Clerk of the Supreme Court of the Northwest Territories, 4903 – 49th Street, Box 550, Yellowknife, Northwest Territories, X1A 2N4, by 12:00 o’clock noon on Friday, May 20, 2022.

The balance of the purchase price shall be paid to the solicitor for the Plaintiff within thirty (30) days after acceptance of the tender. Tenders are irrevocable and shall remain open until dealt with by the Court. If the successful tenderer does not complete the purchase after acceptance of their tender, the deposit shall be forfeited. The highest or any tender will not necessarily be accepted. Cheques of unsuccessful tenderers will be returned to them. The acceptance of any tender and any sale is subject to confirmation by the Court.
